Public offer

1. General provisions

1. This public offer (hereinafter referred to as the «Offer») is addressed to an indefinite circle of persons and is an official public proposal of the Individual Entrepreneur (hereinafter referred to as the «Seller») to conclude a contract for the sale and purchase of goods (hereinafter referred to as the «Contract») on the terms set out below.
2. The Contract is concluded by the Buyer's acceptance of the Offer.
3. Acceptance of the Offer is the performance by the Buyer of the following actions: registration on the Seller's website, adding goods to the cart, and placing an order with or without payment (depending on the payment terms for a specific product).
4. The Seller may at any time make changes to the Offer, which take effect from the moment they are posted on the website.
5. The term of the Offer is not limited. The Seller may cancel the Offer at any time.
6. The fact of placing an order on the Seller's website is unconditional confirmation that the Buyer has read and agrees with the terms of the Offer.

2. Definitions

1. Site — online store located at samson-fit.com, owned by the Seller.
2. Product — physical goods (trainers, spare parts, accessories, drawings) posted on the Site and offered by the Seller for sale.
3. Buyer — a capable natural person who has reached the age of 18, who has placed an order on the Site.
4. Order — the Buyer's request for the purchase of a Product, placed on the Site.
5. Delivery — services for transferring the Product to the Buyer through transport companies or other methods specified on the Site.

3. Subject of the contract

1. The Seller undertakes to transfer into the ownership of the Buyer, and the Buyer undertakes to pay for and accept the Product ordered on the Site.
2. Each Product is accompanied by a description, images, and specifications posted on the Product page. If the description does not match the actual Product, the Buyer has the right to exercise the rights provided by the legislation of the Russian Federation.
3. The price of the Product is indicated on the Site in rubles (RUB), US dollars (USD), or euros (EUR) depending on the selected currency. The price includes all applicable taxes.
4. The Seller may change the price of the Product without prior notice. The new price applies only to orders placed after the change.

4. Order placement and fulfillment

1. The Buyer places an Order by filling out the order form on the Site, providing accurate data: full name, delivery address, contact phone number, email address.
2. After placing the order, a confirmation with the order number and details is sent to the Buyer's specified email.
3. The Seller undertakes to fulfill the order within timeframes depending on product availability in stock and the selected delivery method.
4. If the product is out of stock, the Seller notifies the Buyer and offers a replacement or a refund.
5. The minimum order amount is not established, unless otherwise specified for a particular product.

5. Payment for goods

1. Payment for the Product is made by one of the following methods:
   • Bank card (Visa, Mastercard, MIR) via the YooKassa payment system;
   • International cards and electronic wallets via the Stripe payment system;
2. When paying with a bank card, payment processing takes place on a secure page of the payment system. The Seller does not receive or store the Buyer's bank card data.
3. Payment is considered completed from the moment the funds are credited to the Seller's settlement account.
4. In case of order cancellation before shipment, a refund is made within 5 (five) business days to the same payment system used for the payment.
5. The Buyer confirms that they are the legal owner of the payment instrument used for payment.

6. Delivery of goods

1. Delivery of the Product is carried out by the following methods:
   • CDEK — to a pickup point or by courier;
   • Russian Post — to a post office or by courier;
   • DHL — international delivery;
   • Self-pickup — from the Seller's warehouse.
2. The delivery cost is calculated automatically when placing the order and depends on the weight, dimensions of the product, destination, and the selected delivery method.
3. For free delivery (above a certain order amount), the Seller reserves the right to choose the transport company.
4. Delivery times are approximate and may vary depending on the performance of transport companies. The Seller is not responsible for delivery delays caused by third parties.
5. The risk of accidental loss or damage to the Product passes to the Buyer at the moment the Product is handed over to the transport company.
6. Upon receipt of the goods, the Buyer must check their integrity and completeness. If damage is found, the Buyer must draw up an act jointly with a representative of the transport company.

8. Return and exchange of goods

1. Return and exchange of the Product are carried out in accordance with the legislation of the Russian Federation and the Return policy .
2. The Buyer may refuse a Product of proper quality within 7 days after receipt, provided that its marketable appearance, consumer properties, packaging, and documents are preserved.
3. Return of a Product of improper quality is carried out within the warranty period.
4. Refunds are made within 10 days from the moment the returned Product is received by the Seller.

9. Personal data

1. By placing an order, the Buyer gives consent to the processing of their personal data in accordance with the Privacy policy and Federal Law No. 152-FZ of 27.07.2006 «On Personal Data».
2. The Seller undertakes not to transfer the Buyer's personal data to third parties, except in cases provided for by law, as well as cases of involving third parties to fulfill obligations under the Contract (delivery, payment).

10. Liability of the parties

1. The Seller is responsible for the quality of the delivered Product in accordance with the legislation of the Russian Federation.
2. The Seller is not responsible for:
   • Improper use of the Product by the Buyer;
   • Delivery delays caused by transport companies;
   • Temporary technical failures on the Site;
   • Discrepancy between the Buyer's expectations and the visual characteristics of the Product (see Section 7).
3. The aggregate liability of the Seller to the Buyer is limited to the cost of the paid Product.

11. Force majeure

1. The parties are relieved from liability for non-fulfillment of obligations under the Contract in the event of force majeure circumstances (natural disasters, fires, wars, epidemics, strikes, changes in legislation, and other circumstances that the parties could not foresee or prevent).
2. The party affected by force majeure is obliged to notify the other party within 5 (five) days.

12. Dispute resolution

1. All disputes arising from the Contract are resolved through negotiations. Claims are sent to: support@samson-fit.com.
2. The claim review period is 10 (ten) business days.
3. If it is impossible to resolve the dispute through pre-trial proceedings, the dispute is subject to resolution in court at the Seller's location.

13. Other conditions

1. The Contract takes effect from the moment of the Buyer's acceptance of the Offer and remains in force until the parties have fully fulfilled their obligations.
2. The legislation of the Russian Federation applies to the relations between the parties.
3. The Seller has the right to use the services of third parties to fulfill obligations under the Contract.
4. The invalidity of one of the provisions of the Offer does not entail the invalidity of the remaining provisions.
5. The Buyer confirms that they have read the terms of the Offer, understand them, and accept them in full.
